We recently assisted a worker injured at work to recover the cost of surgery and wages that the insurer had declined.
Our client’s employer’s workers compensation insurer had denied our client’s claim for surgery and weekly wage benefits, claiming the injuries were not sustained in the course of the employment.
The Burgan Lawyers’ team were able to obtain expert medical evidence to show that the injuries requiring surgery were related to other injuries that were sustained in the course of employment and we argued successfully that the insurer should accept liability for these consequential injuries.
After considering the evidence Burgan Lawyers were able to present, the Personal Injury Commission found in favour of the Worker, resulting in approval for the requested surgeries and back-payment of weekly wage benefits from the insurer.
