Burgan Lawyers recently assisted the driver of a classic car (1962 EK Holden) who suffered injuries in a car accident due to a malfunction in the vehicle’s brakes.
What made this case particularly interesting was that the vehicle had been inspected by a mechanic for the purpose of issuing a Blue Slip, less than 24 hours prior to the accident. Our client alleged she asked the mechanic to perform all necessary works in order to render the vehicle roadworthy. The mechanic disputed they performed any relevant works on the brakes, and had properly inspected them insofar as they need to in order to issue a Blue Slip.
While the driver was able to access some compensation through the CTP Scheme, Burgan Lawyers also took action against the mechanic who issued the Blue Slip arguing that a proper inspection of the vehicle would have revealed the defect in the brake system, prompted them being repaired and thus the accident would have been avoided.
It was a difficult case to prosecute, and involved a number of mechanical experts to provide evidence, however Burgan Lawyers were successful in negotiating a settlement and obtaining compensation for our injured client.
